PRIVACY POLICY

Triboo Digitale S.r.l. with registered office in Viale Sarca 336, Building 16, 20126 Milan, VAT number / C.F. and registration number in the Business Register of Milan No. 02912880966 (hereinafter, also “Triboo”) and Tecnica Group S.p.A., with registered office in Via Fante d’Italia n. 56, Giavera del Montello (TV), tax code and VAT number and registration number in the Treviso Company Register no. 00195810262 (hereinafter also “Tecnica Group” and, jointly with Triboo, the “Data Controllers”), as controllers of the personal data of users (hereinafter, the “Users”) who browse and use the services available on the website https://www.rollerblade.com/ (hereinafter, the “Site” and the “Services”) provide hereby the privacy policy pursuant to art. 13 of EU Regulation 2016/679 of 27 April 2016 (hereinafter, the “Regulation”, or also the “Applicable Regulations”).

This Site and the Services are reserved only for individuals who have reached the age of eighteen. Therefore, the Data Controllers do not collect personal data relating to persons under the age of eighteen. Upon request of the Users, the Data Controllers will promptly delete all personal data unintentionally collected and relating to persons under the age of eighteen.

The Data Controllers take into the utmost account the right to privacy and to protect of the personal data of their Users. For any information in relation to this privacy policy, Users can contact the Data Controllers at any time, using the following manners:

Triboo:

  • by sending a registered letter with acknowledgement of receipt to the registered office of the Data Controller in Viale Sarca 336, Building 16, 20126 Milan; or

Tecnica Group:

1. Purpose of the processing
Users’ personal data will be lawfully processed by Triboo pursuant to art. 6 of the Regulation for the following purposes:

  • contractual obligations and provision of the Services, to allow navigation on the Site or to execute the terms for Use of the Site, which are accepted by the User by registering on the Site and / or when using the Services and to fulfill to specific requests of the User. The User data collected by Triboo for the purposes listed above include: name, surname and nickname voluntarily chosen, age, province of residence / domicile, gender, e-mail address, as well as all personal data belonging to the User that are possibly and voluntarily published. The User’s personal data will be used by Triboo for the exclusive purpose of ascertaining the User’s identity (also by validating the e-mail address), thus avoiding possible online scams or abuses, and of contacting the User for official reasons only (eg to send notifications relating to the Services). Without prejudice to the provisions elsewhere in this privacy policy, in no case will Triboo make the Users’ personal data accessible to other Users and / or third parties.
  • administrative-accounting purposes, meaning to carry out activities of an organizational, administrative, financial and accounting nature, such as internal organizational activities and activities that are functional to the fulfillment of contractual and pre-contractual obligations;
  • legal obligations, meaning to fulfill obligations set out by law, by an authority, by a regulation or by European legislation.

The provision of personal data by the User for the purposes specified above is optional but necessary, since failure to provide them will make it impossible for the User to browse the Site, register on the Site and use the Services.
The personal data that are necessarily requested for the pursuit of the processing purposes as described in paragraph 1 are marked by an asterisk in the registration form on the Site.

2. Additional processing purposes: marketing and profiled marketing (sending advertising material, direct sales and commercial communication)
With the User’s voluntary and optional consent, some personal data of the User (i.e. the name, surname, e-mail address, Country, language, date of birth and information relating to the Services to which himself has expressed his interest) may be processed by Tecnica Group also for marketing and profiled marketing purposes (to reconstruct the User's tastes and consumption habits, identifying the consumer profile, in order to be able to send the User commercial offers), and so Tecnica Group can contact the User by mail, certified electronic mail, telephone (with automated systems such as, for example, messaging systems, with and without human intervention) to propose to the User the purchase of products and / or services offered by the Tecnica Group itself and / or by third-party companies, to present offers, promotions and commercial opportunities.

In case of lack of consent, the possibility of subscribing to the Site will not be affected in any way.

In the event the consent is granted, the User may at any time revoke it, by making a request to Tecnica Group in the manner indicated in paragraph 5 below.

The User can also easily oppose to further sending of promotional communications by e-mail and also by clicking on the appropriate link for the withdrawal of consent, which is present in each promotional e-mail. Once the consent has been revoked, Tecnica Group will send the User an e-mail message to confirm the withdrawal of the consent. If the User intends to revoke his consent to the sending of promotional communications by telephone, while continuing to receive promotional communications via e-mail, or vice versa, the User has to send a request to the Data Controller following the manner indicated in paragraph 5 below.

Tecnica Group informs that, regarding the exercise of the right of the User to oppose to the sending of promotional communications via e-mail, it is possible that, for technical and operational reasons (eg formation of contact lists already completed before the receipt of the opposition request) the User will continue to receive some additional promotional messages. If the User continues to receive promotional messages after 24 hours from the exercise of the right of opposition, the User has to report the problem to Tecnica Group immediately, using the contacts indicated in paragraph 5 below.

3. Processing methods and period for the retention of traffic data
The Data Controllers will process the Users’ personal data using manual and IT tools, just to fulfill the purposes set out herein and, in any case, in order to guarantee the security and confidentiality of the data.

Users’ personal data will be kept for the time strictly necessary to carry out the purposes set out in paragraph 1, or in any case, if necessary for protecting the interests of Users and Triboo in civil proceedings.
In the cases referred to in paragraph 2 above, the personal data of Users will be kept for the time strictly necessary to carry out the purposes described therein and in any case for no more than ten years from the date on which Tecnica Group acquired the User’s last consent.

4. Scope of communication and dissemination of data
The employees and / or collaborators of the Data Controllers in charge of managing the Site and all the services connected to the provision of the Services may become aware of the Users’ personal data. These persons, who have been instructed to do so by the Data Controllers pursuant to Article 29 of the Regulation, will process Users’ data exclusively for the purposes set out in the privacy policy and in compliance with the provisions of the Applicable Regulations.

Third parties who may process personal data on behalf of the Data Controllers as “External Data Processors” may also become aware of the Users’ personal data. For example, these persons could be suppliers of IT and logistic services, used for improving the operation of the Site and / or the Services, outsourced or cloud computing service providers, professionals and consultants

Users have the right to obtain a list of any data processors appointed respectively by each Data Controller, by making a request to the Data Controller concerned in the manner indicated in paragraph 5 below.
Furthermore, the personal data of the Users may be communicated by Triboo, only if this is necessary and essential to execute contractual obligations, to independent third parties data controllers, such as the payment services and the logistics services operators for the delivery of goods sold through the Site. These independent owners will process the User’s data exclusively for the purpose of the correct fulfillment of orders relating to the Services.

5. Rights of the data subjects
Users may exercise the rights guaranteed in the Applicable Regulations, by contacting the Data Controllers in the following manners:

Triboo will comply with the requests of Users relating to the treatments referred to in paragraph 1, while Tecnica Group will comply with the requests of Users relating to the treatments referred to in paragraph 2.

Pursuant to the Applicable Law, the Data Controllers inform that Users have the right:

  • to access, to rectify, to cancel, to limit and to oppose to the processing of data;
  • to obtain without hindrance from the Data Controller the data in a format legible by an automatic device in order to transmit it to another data controller;
  • to revoke the consent to the data processing, without prejudice to the lawfulness of the processing based on the consent acquired before the revocation;
  • to lodge a complaint with the Data Protection Supervisor.

The Data Controllers are not responsible for updating all the links that can be viewed in this privacy policy, therefore whenever a link is not functional and / or updated, Users acknowledge and accept that they must always refer to the documents and / or sections of the websites recalled by these links.
